This Fair Use Policy (“Policy”) is part of our Privacy Policy (“Legal Terms”) and should therefore be read alongside our main Legal Terms: Terms of Use. Who we are? We are Dialaxy (“Company,” “we,” “us,” or “our”) a company registered in Singapore. We operate, as well as any other related products and services that refer or link to this Policy (collectively, the “Services”). If You have subscribed to any of our Services, then the following terms would be applicable: (a) All plans shall be used only for normal business purposes; live dialog between two individuals; for call centers; (b) You shall not engage in Trunking or forwarding the Dialaxy Number to another phone number(s) capable of handling multiple simultaneous calls, or to a private branch exchange (PBX) or a key system; Auto-dialing or “predictive” dialing (i.e., non-manual dialing or using software programs or other means to continuously dial or place out-bound calls; making outgoing calls or sending messages or faxes using a the Dialaxy Number, as CLI via a third party provider, unless mutually agreed in writing by the Parties. As a part of the user verification process, You may be requested to provide us the following information for each number: name, ID number, place of residence or business (street, number, zip code, city, country), corresponding IP address, business registration certificate where the User is a legal entity and any other relevant information (the “User Information”). You shall keep the User Information up to date and shall ensure that any User Information provided to Us identifies the true user of that number. Upon Our request, You shall submit to Us within 24 hours the User Information and all other relevant information concerning the services you are providing. Further, You shall provide contact details of a representative responsible for handling law enforcement agency requests and responding to Our communications. If you have subscribed to the plan which provides unlimited calling service, all incoming and outgoing call are subjected to fair usage limit and upon reaching the limit , user shall be shifted to other plans. In this case , user might get charged extra for calling after crossing fair usage limit . While purchasing the plan you can select country for which you wish to get minutes benefits , you will get benefits of free minutes (as per fair usages policy ) for only one country which you have selected while purchasing the office phone system plan. 2. Use of the services When you use the Services you warrant that you will comply with this Policy and with all applicable laws. You also acknowledge that you may not: Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us. Make any unauthorized use of the Services, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited emails, or creating user accounts by automated means or under false pretenses. Circumvent, disable, or otherwise interfere with security-related features of the Services, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Services and/or the Content contained therein. Engage in unauthorized framing of or linking to the Services. Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords. Make improper use of our Services, including our support services, or submit false reports of abuse or misconduct. Engage in any automated use of the Services, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools. Interfere with, disrupt, or create an undue burden on the Services or the networks or the Services connected. Attempt to impersonate another user or person or use the username of another user. Use any information obtained from the Services in order to harass, abuse, or harm another person. Use the Services as part of any effort to compete with us or otherwise use the Services and/or the Content for any revenue-generating endeavor or commercial enterprise. Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services, except as expressly permitted by applicable law. Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Services. Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Services to you. Delete the copyright or other proprietary rights notice from any Content. Copy or adapt the Services’ software, including but not limited to Flash, PHP, HTML, JavaScript, or other code. Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Services or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Services. Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “pcms”). Except as may be the result of the standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Services, or using or launching any unauthorized script or other software. Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services. Use the Services in a manner inconsistent with any applicable laws or regulations. 2.1 Rules for Messaging and Calling At Dialaxy, we strive to uphold a secure, respectful, and fully compliant communications platformThe following rules apply to all use of our messaging and calling features. By using Dialaxy, you agree to comply with the standards below. These rules are designed to prevent misuse and abuse of our services, safeguard users from harmful or unlawful content, and ensure compliance with all applicable laws and regulations. All users of Dialaxy must understand and adhere to these messaging standards, and any violation may result in account suspension, service termination, or other legal action as appropriate. By using Dialaxy’s messaging services, you agree to these conditions and acknowledge that any content or activity undermining the safety, integrity, or legality of our platform is strictly prohibited; this list is not exhaustive, and Dialaxy reserves the right to take action against any such content or behavior. Rules for Messaging You shall not use Dialaxy’s messaging services to send, transmit, or assist in the delivery of: 1. Harmful or Offensive Content Content that is obscene, defamatory, threatening, intimidating, harassing, exploitative, hateful, abusive, racially or ethnically offensive, or that incites illegal or violent behavior. Content that promotes hate speech, extremist ideologies, or seeks to coordinate harm, including communications encouraging physical, reputational, or digital attacks. Abusive language, including any content intended to demean, belittle, or psychologically harm an individual or group. 2. Fraudulent, Deceptive, or Misleading Content Fraudulent or deceptive messages, including impersonation, misrepresentation, scams, phishing, or any attempt to extract personal, financial, health-related, or other sensitive information under false pretenses. Cold messages or unsolicited communications sent without prior, verifiable recipient consent, including spam or promotional content that lacks clear opt-out instructions. Third-party lead generation or marketing that: Engages in deceptive practices (e.g., disguised offers, misleading funnels), Involves data-sharing without full transparency, Promotes or sells consumer information without proper notice and consent. 3. Malicious or Technologically Harmful Content Malware, viruses, spyware, or any content intended to compromise recipient devices, data security, or service integrity 4. Prohibited Product or Service Promotions Messages that promote, reference, or facilitate the offer, sale, or marketing of the following: Drugs and Drug-related Products: Cannabis, CBD, kratom, vape products (including e-cigarettes), Paraphernalia or accessories related to any restricted substances, Indirect promotions using cannabis-linked images, domains, or branding—even without explicit terms. Prescription medication or unapproved medical treatments. Adult or Restricted Services: Sexual or adult services of any kind, Gambling, betting, casino apps, or similar services, Alcohol, tobacco, or firearms. Fireworks or explosives, regardless of legal status in any jurisdiction. 5. High-risk Financial Services and Schemes Messages relating to: High-risk or misleading financial services, including: Payday loans, affiliate lending, short-term high-interest loans, student loans (where not clearly licensed or disclosed), or crypto/investment platforms not regulated by recognized authorities, Loan offerings or debt collection efforts not serviced by the sender or lacking proper licensure, Deceptive financial schemes, including: Mystery shopping scams, work-from-home scams, pyramid schemes, or multi-level marketing (MLM), “Get rich quick” schemes or speculative investment opportunities, Debt consolidation, credit repair, debt forgiveness, or debt reduction programs. Rules for Calling To maintain a secure, respectful, and legally compliant calling environment, all users must adhere to the following standards when using Dialaxy’s services: 1. No Harassment or Abuse Calls must not contain obscene, defamatory, threatening, intimidating, harassing, hateful, or racially or ethnically offensive language. Any form of abuse—whether physical, psychological, or reputational—is strictly prohibited. This includes content that directly or indirectly encourages coordinated harm, exploitative behavior, or violence. 2. No Fraudulent or Deceptive Activities Impersonation, misrepresentation, phishing, scams, or any attempt to deceitfully obtain personal or sensitive information (such as financial, health, or identity data) are strictly prohibited. Calls must not use coercion or deception to extract such information. 3. Cold Calling and Consent Mechanisms Unsolicited or cold calls without the recipient’s clear, prior consent are not allowed. Users must: Provide explicit, easily accessible opt-out mechanisms; Fully respect recipient preferences, including do-not-call requests; Honor time-of-day restrictions as per applicable telemarketing laws. 4. Restricted Topics and Prohibited Promotions Calls must not promote, reference, or offer: Illegal or controlled substances (e.g., drugs, narcotics, cannabis, kratom); Sexual or escort services, including implied or indirect references; Gambling or betting services; Alcohol, tobacco, firearms, explosives, or related accessories; Third-party lending services, including loan offerings where the caller is not the direct lender or licensed servicer; High-risk or deceptive financial services, such as cryptocurrency schemes, payday loans, pyramid schemes; Student loan agents or debt-related services that are not clearly regulated under applicable financial laws; Debt collection, credit repair, consolidation, or financial assistance services that do not align with fair lending standards; Unapproved medical treatments, unsafe dietary supplements, or untested remedies that pose risks to consumer health or safety. 5. Compliance with Laws and Regulations All calls must comply with applicable: Telecommunications, privacy, data protection, and consumer-protection laws; Telemarketing regulations, including caller ID accuracy, truthful service descriptions, do-not-call compliance, and time-of-day restrictions; Local and international financial laws, where relevant to the nature of the call. 6. Privacy-Centered Calling Standards Users must uphold the highest standards of privacy. This includes: Maintaining full transparency in call intent and data usage; Avoiding any tactics that pressure or deceive users into sharing sensitive personal information. 7. Ethical and Respectful Communication Users must maintain a professional, courteous, and ethical tone in all calls. Communication should be constructive and respectful of the recipient’s time, privacy, consent, and boundaries. 8. Audit, Monitoring, and Enforcement Dialaxy reserves the right to: Monitor call patterns and content for compliance; Conduct regular or targeted audits; Take enforcement actions, including call blocking, temporary suspension, or permanent account termination in cases of violation. 9. Reporting Mechanism Users are encouraged to report suspected violations or abuse. Reports will be reviewed promptly, and appropriate enforcement actions will follow. 3. Consequences of breaching this policy The consequences for violating our Policy will vary depending on the severity of the breach and the user’s history on the Services, by way of example: We may, in some cases, give you a warning, however, if your breach is serious or if you continue to breach our Legal Terms and this Policy, we have the right to suspend or terminate your access to and use of our Services and, if applicable, disable your account. We may also notify law enforcement or issue legal proceedings against you when we believe that there is a genuine risk to an individual or a threat to public safety.
